Acceptable Use Policy

The rules for using Ciaomatic responsibly and lawfully. Incorporated into the Terms of Service.

This Acceptable Use Policy (the "AUP") governs your use of the Ciaomatic service and is incorporated into, and forms part of, the Terms of Service. Capitalized terms have the meaning given in the Terms. Violating this AUP is a breach of the Terms and may result in immediate suspension or termination and, where warranted, notification to authorities.

You are responsible for all activity on your account and for the conduct of every agent you configure. You must ensure your use complies with all applicable laws in the jurisdictions of you and your callers.

1. Prohibited telephony abuse

You must not use the Service to engage in, facilitate, or enable telecommunications fraud or abuse, including:

  • International Revenue Share Fraud (IRSF), traffic pumping, or artificially inflating traffic to premium-rate, high-cost, or revenue-share numbers or destinations.
  • Dialing premium-rate or blocked prefixes, or attempting to bypass our geographic dialing restrictions or destination blocklists.
  • Autodialing, war-dialing, or generating call volumes intended to overload or probe networks.
  • Caller-ID spoofing, number manipulation, or misrepresenting the origin of a call.

2. No unlawful or non-consented outbound calling

The Service is designed to answer inbound calls and to place limited verification and test calls. You must not use it for unsolicited outbound calling campaigns, robocalling, or telemarketing that violates applicable law, including the U.S. Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, Do-Not-Call requirements, and equivalent laws elsewhere. You must obtain any consent legally required before contacting a person and must honor opt-outs.

Test-call destinations must be verified and are subject to per-day quotas and time limits. You must not use verification or test features to reach numbers you do not control or to harass, defraud, or incur charges against others.

3. No harassment, deception, or harmful content

You must not configure agents to harass, threaten, defame, deceive, or defraud callers; to impersonate a person or organization without authorization; to unlawfully practice a regulated profession; to promote illegal activity; or to generate or solicit unlawful, hateful, sexually exploitative, or otherwise harmful content. You must not misrepresent the agent as a human where disclosure is required, or where doing so would deceive a caller to their detriment.

4. No unlawful call recording

You must not enable or use call recording in violation of applicable recording-consent laws, including one-party and all-party (two-party) consent rules and data-protection laws such as the GDPR. Our in-call recording announcement is an aid, not a guaranteed or sufficient consent mechanism, and does not relieve you of your obligations. You are responsible for obtaining any required consent and providing any required notice.

5. Not for emergencies

You must not use or present the Service as a way to reach emergency services (such as 911 or 112) or as a substitute for them. The Service cannot dispatch emergency help and must never be relied upon in a situation where failure could cause injury, loss of life, or property damage.

6. No interference or misuse of the platform

You must not:

  • Attempt to gain unauthorized access to the Service, other accounts, or our or our providers' systems, or probe, scan, or test their vulnerability.
  • Interfere with or disrupt the Service, circumvent usage limits, quotas, caps, or billing, or resell or provide the Service to third parties except as expressly permitted.
  • Introduce malware, or use the Service to store or transmit infringing, unlawful, or malicious material.
  • Use the Service in violation of export controls, sanctions, or other trade-control laws.

7. Data protection and privacy

You must handle the personal data of your callers lawfully, provide any privacy notices they are entitled to, and have a lawful basis for the processing you direct us to perform on your behalf. You must not use the Service to process data in ways your callers have not been informed of or, where required, consented to.

8. Enforcement

We may investigate suspected violations and may suspend or terminate access, block specific calls or destinations, remove content, and cooperate with law enforcement. We may enforce this AUP automatically (for example, through quotas, blocklists, and geographic restrictions) or manually. We are not obligated to monitor use of the Service but may do so.
